“Internal Committee” under Sub section (1) of section 4 of The Sexual Harassment of Women at Workplace (P,P&R) Act, 2013

 
 
Every employer having 10 or more employees at its place is obliged to constitute a committee known as “Internal Committee” at different administrative units or offices of the establishments. This committee should consist of the following members/employees nominated by employer,
 
 
  • Presiding officers who shall be women employed at a senior level at workplace
  • 02 members who are committed to the cause of women or have any legal knowledge or have work experience in social issues,
  • 01 member from non-government organisation or association committed to the cause of women or a person familiar with issues relating to sexual Harassment 
 
 
Committee should consist of at-least 04 members including presiding officer and it shall hold office maximum for a period of 03 years from the date of their appointment. It is necessary that all times minimum 50% of the members of this committee must be women.
 
This Act further provides for parallel grievance redress committee namely “Local Complaint Committee”. Employer having less than 10 employees may tie up with “Local Complaint committee”.
 
 
 

"Works Committee” under Section 3 of the Industrial Disputes Act,1947 

Where 100 or more workmen are employed or have been employed on any working day in the preceding 12 months. 

The Works Committee will be comprised of the representatives of employers and workmen engaged in the establishment. It shall be the duty of the Works Committee to promote measures for securing and preserving amity and good relations between the employer and workmen and, to that end, to comment upon matters of their common interest or concern and endeavour to compose any material difference of opinion in respect of such matters [Section 3(2)]. 

 
 

"Safety Committee” U/s 68-F of Gujarat Factories Rules,1963 

In every factory wherein 250 or more workers are ordinarily employed, there shall be a Safety Committee.

The representatives of the management of Safety Committee shall be include:-

 

  • a senior official, who by his position in the organisation can contribute effectively to the functioning of the Committee, shall be the Chairman:
  • a safety officer and a Factory Medical Officer wherever available and the safety officer in such a case shall be the Secretary of the Committee;
  • a representative each from the production, maintenance and purchase departments. The workers representatives on this Committee shall be elected by the workers.

 

The tenure of the Committee shall be 02 years, Safety Committee shall meet as often as necessary but at least once in every quarter. The minutes of the meeting shall be recorded and produced to the Inspector on demand.
